PREAMBLE, PURPOSE & INTERPRETATION (EXTENDED VERSION)
1.1 Preamble & Overarching Intent
This Terms & Conditions document ("Terms", "Agreement", "User Agreement") constitutes a legally
binding contract between Winngoo Infini India Private Limited, a company incorporated under the
Companies Act, 2013, having its registered office in India ("Winngoo Infini", "Company", "We", "Us",
"Our"), and any natural or legal person accessing the Winngoo Infini digital ecosystem ("User",
"You", "Your").
1.2 Purpose & Scope
These Terms regulate the full spectrum of digital services provided by the Company, including but not limited to:
- cashback reward processing,
- coupon and voucher issuance,
- referral-based promotional programs,
- digital advertising and merchant visibility services,
- online promotional campaigns,
- customer engagement tools,
- user-merchant interaction facilitation.
1.3 Interpretation Principles
- Words denoting gender include all genders.
- Words using the singular include the plural and vice versa.
- Headings are inserted for convenience only and do not affect interpretation.
- Any reference to an act or statute includes amendments, replacements, or re-enactments thereof.
- References to "Platform" include website, mobile site, mobile app, integrated partner systems, and future extensions.
1.4 Non-Negotiability of Terms
This Agreement is non-negotiable, and continued usage signifies unconditional acceptance of every
clause herein. You agree that your use creates constructive notice of all obligations and liabilities embedded within these Terms.
DEFINITIONS, KEY TERMINOLOGY & SCOPE OF APPLICATION
2.1 Defined Terms
(i) "Platform"
The digital ecosystem comprising the website winngooinfini.com/in, all sub-domains, any mobile applications, APIs,
backend systems, merchant dashboards, customer dashboards, and technology frameworks operated by the Company.
(ii) "Reward Instruments"
This includes cashback credits, loyalty points, merchant vouchers, exclusive discount codes, referral bonuses,
reward tokens, digital stamps, or any similar benefit provided by the Company.
(iii) "Merchant Partner"
Any entity, business, freelancer, digital seller, retailer, service provider, hospitality unit, food outlet, brand partner,
or third-party vendor participating in Winngoo Infini's ecosystem.
(iv) "Fraud Activity"
Includes fake accounts, duplicate accounts, artificially triggered referrals, fabricated transactions, unauthorized
access attempts, manipulation of digital instruments, or any behaviour intended to obtain unjust benefit.
(v) "Registered User"
A person who completes the Platform registration process and is authenticated through OTP, email,
or other verification mechanisms.
2.2 Scope of Application
- All Users accessing or interacting with the Platform;
- All merchant partners engaging with Winngoo Infini;
- All activities conducted through the Platform, including promotional usage even without registration;
- All transactions, irrespective of the device or location of access.
2.3 Hierarchy of Governance
- Specific service-level agreements override general clauses,
- Internal policy documents override external FAQs,
- These Terms override any oral arrangement, communication or representation made by any employee or agent.
ACCEPTANCE OF TERMS & CONTRACTUAL OBLIGATION
3.1 Binding Nature of the Agreement
By using, engaging, or accessing the Platform, you irrevocably agree to be contractually bound by these Terms
as per the Indian Contract Act, 1872, whether or not you have explicitly clicked any "Accept" button.
3.2 Constructive & Implied Consent
Even passive engagement—such as browsing, viewing merchant pages, or clicking promotional listings—constitutes
acceptance, creating a valid and enforceable contractual relationship.
3.3 Right to Amend Terms
Winngoo Infini reserves the unilateral right to update, modify, replace, or delete any portion of these Terms at any
time, without prior consent from the User. Continued usage signifies acceptance of modified Terms.
3.4 User Responsibility to Review Terms
You acknowledge that the responsibility to review updated Terms lies solely upon you.
Lack of awareness of updates shall not be a defence against enforcement.
USER ELIGIBILITY, CAPACITY, VERIFICATION & ACCOUNT CREATION
4.1 Legal Eligibility
- be at least 18 years of age;
- possess the legal capacity to contract as defined under the Indian Contract Act;
- not be disqualified by any applicable law or judicial order.
4.2 Account Creation Protocols
Accounts may be created only with truthful, complete, and up-to-date information. Winngoo Infini may require:
- Mobile OTP verification
- Email authentication
- Aadhaar/KYC verification (if legally required)
- Government ID proof in case of suspected fraud
4.3 Responsibilities of the User
- maintain confidentiality of login credentials,
- restrict account access to yourself only,
- promptly report unauthorized usage,
- avoid misleading information.
4.4 Prohibition on Multiple / Fake Accounts
Creation of more than one account per individual, or any fake, bot-generated, or manipulated accounts,
constitutes a material breach.
4.5 Right to Deny / Terminate Account
- Refuse account creation,
- Suspend account pending investigation,
- Permanently terminate account,
- Forfeit rewards, points, cashback, and referral earnings.
DESCRIPTION OF SERVICES, FUNCTIONAL SCOPE & LIMITATIONS
5.1 Nature of Services
Winngoo Infini provides a multi-layered digital promotion and rewards ecosystem, including but not limited to:
- cashback reward tracking and disbursement,
- merchant-based promotional campaigns,
- referral incentive programs,
- digital coupon issuance,
- loyalty reward systems,
- online visibility tools for businesses,
- programmatic ad placements,
- data-driven promotional marketing.
5.2 Intermediary Role
Winngoo Infini is an intermediary in accordance with the Information Technology Act, 2000 and is not the
manufacturer, seller, or provider of services offered by merchant partners.
5.3 Non-Guarantee of Rewards
Rewards, cashback, vouchers, or promotional benefits are provided solely based on:
- compliance with stated criteria,
- acceptance by the relevant merchant,
- successful system validation,
- absence of fraud indicators.
5.4 Platform Availability & Downtime
The Platform may experience planned or unplanned downtime. The Company shall not be liable for delays,
losses, or failures resulting from maintenance, outages, or system errors.
5.5 Right to Modify or Discontinue Services
- discontinue any program permanently,
- modify cashback calculations,
- revise referral conditions,
- deprecate old services,
- introduce new premium or subscription models.
CASHBACK, REWARD CREDITS & REDEMPTION POLICY
6.1 Nature of Cashback
Cashback provided by Winngoo Infini ("Cashback", "Reward Credit", "Credit Balance") represents a conditional,
non-monetary, non-transferable promotional benefit issued solely for user engagement. Cashback is not legal
tender, not redeemable for cash unless specifically permitted, and carries no intrinsic cash value outside
the Platform.
6.2 Eligibility Conditions
Cashback is awarded strictly upon fulfillment of all of the following:
- the User must have a valid, active, and non-suspended account at the time of awarding;
- the transaction must comply with merchant requirements;
- the transaction must not be fraudulent, manipulated, or artificially generated;
- the User must meet timeline requirements, minimum spends, and offer-specific conditions.
6.3 Merchant Validation Requirement
Cashback shall be released only after the merchant partner confirms the validity of the transaction.
If a merchant rejects or disputes the transaction, the Company is under no obligation to issue cashback.
6.4 Pending, Hold & Frozen Cashback Status
The Company may assign cashback to various states:
- Pending - awaiting merchant confirmation;
- On Hold - awaiting additional verification or system checks;
- Frozen - suspected of fraud or flagged for audit;
- Rejected - deemed invalid under program terms.
6.5 Expiry of Cashback
- A fixed validity period,
- Offer-specific expiry timelines,
- Automatic expiration after prolonged inactivity,
- Purge under policy revisions or system clean-ups.
Users agree that expired cashback cannot be reinstated.
6.6 Rollback Rights
The Company reserves full rights to roll back or revoke any credited cashback in cases involving:
- merchant reversals;
- product refunds or cancellations by user;
- fraudulent transactions;
- system error or technical glitch;
- violation of promotional terms.
6.7 No Guarantee Clause
Issuance of cashback is NOT GUARANTEED, and the User acknowledges that the Company may deny cashback in
whole or in part for reasons including but not limited to fraud suspicion, incomplete validation, or internal
policy updates.
COUPONS, VOUCHERS, PROMOTIONAL CODES & USAGE LIMITS
7.1 Nature of Vouchers & Coupons
Coupons, vouchers, or promotional codes issued by the Platform ("Promo Instruments") are conditional digital
tools allowing Users to receive merchant-specific benefits.
7.2 Non-Transferability
- Non-transferable,
- Non-exchangeable,
- Cannot be sold, resold, traded, or bartered,
- Cannot be converted to cash.
7.3 Merchant Terms Override
Merchant-specific terms govern:
- Redemption conditions,
- Minimum order conditions,
- Validity periods,
- Item/exclusion lists,
- Redemption limits.
Where merchant terms conflict with Platform terms, merchant terms shall prevail for redemption.
7.4 Usage Abuse Prohibited
- sharing coupon codes publicly when marked private;
- using single-use codes multiple times;
- manipulating system timestamps to bypass expiry;
- redeeming codes via bots or automated tools.
7.5 Redemption Errors
Winngoo Infini is not responsible for:
- Merchant-side system failures,
- POS device failures,
- Invalid code errors,
- Expired coupon denials,
- Merchant refusal due to operational constraints.
7.6 Voucher Revocation Rights
The Company may suspend, modify, cancel, or revoke any voucher without notice if:
- suspicious activity is detected;
- system error is identified;
- abuse patterns emerge;
- offer terms change or merchant exits the program.
REFERRAL PROGRAM, BONUS STRUCTURE & FRAUD CONTROLS
8.1 Referral Program Overview
Winngoo Infini operates a structured referral program wherein:
- Users may invite new participants;
- Users may earn rewards for valid referrals;
- Rewards may include digital points, cashback, or vouchers.
8.2 Conditions for a "Valid Referral"
- the referee is a first-time user;
- the referee completes full registration;
- the referee performs required qualifying activities;
- no duplication of device, IP, mobile number, or ID is detected.
8.3 Anti-Fraud Algorithms
- Multiple accounts on the same device;
- Unnatural referral patterns;
- Rapid self-referral chains;
- Bulk SMS or spam referral links;
- VPN-based location spoofing;
- Automated sign-ups.
8.4 Referral Bonus Freezing & Forfeiture
Referral rewards may be withheld, frozen, or permanently forfeited when:
- referral chain is artificial;
- accounts are interconnected beyond permissible limits;
- suspicious logins or device cloning is detected;
- referral flow violates fair usage policy.
8.5 Modification of Referral Program
The Company may modify, restrict, pause, or terminate the referral system without any liability to the
User.
PROHIBITED ACTIVITIES, FRAUD PREVENTION & SECURITY POLICY
9.1 General Prohibited Conduct
Users shall NOT engage in any activity that:
- undermines Platform integrity;
- compromises system security;
- manipulates reward mechanisms;
- involves impersonation of other users;
- violates Indian law or digital system guidelines.
9.2 Specific Prohibited Actions
- creating fake identities;
- using shared numbers/IDs for multiple accounts;
- submitting forged invoices;
- uploading manipulated screenshots;
- engaging in referral farming;
- exploiting system glitches;
- reverse engineering the Platform;
- performing DDOS attacks;
- accessing confidential merchant data;
- phishing, scamming, or misusing user data.
9.3 Fraud Detection Mechanisms
- Device fingerprinting,
- IP anomaly checks,
- Geolocation analysis,
- Behavioural pattern modelling,
- AI-based anomaly scoring,
- Manual audits & KYC reviews.
9.4 Consequence of Violations
Violations may result in:
- immediate account suspension;
- permanent account termination;
- forfeiture of cashback, vouchers, and pending rewards;
- blacklisting from future programs;
- reporting to authorities under the IT Act 2000, IPC 420/468/471, and other applicable laws.
9.5 Right to Investigate
The Company reserves absolute authority to:
- Request documents,
- Request in-person verification,
- Demand government ID proof,
- Conduct merchant-level cross-verifications,
to investigate suspicious activity.
PAYMENT TERMS, FEES, SUBSCRIPTION RULES & NO-REFUND POLICY
10.1 Payments for Premium Services
Some services may require payment including:
- merchant advertising plans,
- visibility boosters,
- exclusive voucher bundles,
- premium cashback tiers,
- subscription-based enhancements.
10.2 Payment Gateways
Payments may be processed through third-party gateways. The Company:
- does not store card data;
- is not responsible for gateway downtime;
- is not liable for gateway errors.
10.3 Taxes & Invoices
Applicable GST or taxes may be charged as per Indian laws. Invoices may be emailed or accessible via
dashboard.
10.4 Strict No-Refund Policy
Unless explicitly stated otherwise in an offer, ALL purchases—including digital services, subscriptions,
voucher packs, promotional payments—are non-refundable.
10.5 Subscription Auto-Expiry
Subscriptions do not guarantee renewal. The Company may:
- discontinue plans,
- revise pricing,
- change deliverables.
10.6 Chargebacks Prohibited
Initiating chargebacks without valid justification is considered a violation and may result in:
- account blacklisting,
- forfeiture of benefits,
- legal action for recovery of losses.
11. USER CONDUCT, RESPONSIBILITIES & ACCEPTABLE USE POLICY (AUP)
11.1 General Standards of User Behaviour
Each User expressly agrees to conduct themselves in a lawful, ethical, and responsible manner while accessing or utilising the Platform or any service provided by Winngoo Infini India...
11.2 Prohibition Against Abusive, Harmful, or Unlawful Actions
- (a) threatens, harasses, intimidates, defames, insults, abuses, or violates the dignity of any individual;
- (b) promotes or disseminates obscene, pornographic, exploitative, discriminatory, hateful, violent, or otherwise objectionable content;
- (c) is prejudicial to public order, decency, morality, or communal harmony;
- (d) constitutes impersonation, identity theft, misrepresentation, or fraudulent representation;
- (e) causes harm to minors, vulnerable persons, or protected groups;
- (f) violates intellectual property rights, privacy rights, confidentiality obligations, or proprietary interests of Winngoo Infini India or third parties.
11.3 Restrictions on Digital Asset Misuse
- (a) alter, modify, duplicate, re-engineer, or manipulate digital cards beyond permitted customisation tools;
- (b) distribute digital assets in bulk or for commercial gain without a written licence;
- (c) upload content that infringes trademarks, copyrights, design rights, personality rights, or moral rights;
- (d) embed content that promotes political campaigns, illegal activities, hate speech, or unverified financial schemes;
- (e) circumvent watermarking, digital rights management (DRM), encryption, or security mechanisms.
11.4 Content Submission Responsibilities

- (a) transmitting viruses, malware, spyware, or malicious scripts;
- (b) executing denial-of-service (DoS/DDoS) attempts;

- (d) bypassing authentication, firewalls, or access control measures;
- (e) deploying bots, auto-scripts, scrapers, or automated extraction tools to access content or data.
11.6 False Complaints, Abuse of Support Channels & Misrepresentation

14. PAYMENTS, FEES, TAXES & BILLING COMPLIANCE

14.4 GST and statutory taxes may apply.
14.5 Payment confirmation is required before delivery.
14.6 Fraudulent payments may result in termination and legal action.
14.7 User authorizes tokenized payment information storage per RBI guidelines.
15. INVOICING, RECEIPTS & ACCOUNTING RECORDS
15.1 The Platform may issue digital invoices immediately upon purchase.
15.2 Winngoo reserves the right to modify invoice formats.
15.3 Duplicate invoice requests must match original transactions.
15.4 Winngoo may store invoice logs for audits.
15.5 Users must provide accurate billing details.
16. REFUNDS, CANCELLATIONS & REPLACEMENTS
16.1 Strict No-Refund Policy applies to all digital products.
16.2 Refunds are not provided for incorrect customizations done by Users.
16.3 Refunds are not applicable for delays caused by network, email service, or device issues.
16.4 In case of technical failure on Winngoo's server, Winngoo may re-issue the purchased card free of cost.
16.5 Refunds for third-party gift cards follow the policies of the issuing brand—not Winngoo.
17. DELIVERY POLICY & DIGITAL DISTRIBUTION
17.1 Delivery is done instantly or within minutes depending on rendering load.
17.2 Email/SMS delivery is dependent on third-party channels.
17.3 In rare cases of server congestion, delivery may take up to 24 hours.
17.4 Winngoo is not liable for incorrect email/phone numbers entered by the User.
17.5 Once delivered, digital cards cannot be recalled, edited, or revoked.
18. RECORD KEEPING, DOCUMENT RETENTION & AUDIT CONTROLS
18.1 Winngoo maintains logs of transactions, IP activity, account operations, and customisation metadata.
18.2 These logs may be preserved for up to 7 years depending on compliance obligations.
18.3 Winngoo may conduct internal or third-party audits for operational, legal, and financial compliance.
18.4 All audit findings remain confidential unless required by law enforcement.
19. DATA COLLECTION, CONSENTS & USER PERMISSIONS
19.1 Users grant consent for collection of basic information such as name, mobile number, email, and usage behaviour.
19.2 Winngoo may process data under the Digital Personal Data Protection Act (DPDPA) 2023.
19.3 Consent is voluntary but required for account creation.
19.4 Users may request withdrawal of consent which may terminate services.
20. PRIVACY & CONFIDENTIALITY OBLIGATIONS
20.1 Winngoo shall ensure reasonable data protection measures.
20.2 User data shall not be sold or rented.
20.3 Data may be shared with law enforcement upon valid legal request.
20.4 Confidential business information shall not be disclosed except for compliance.
21. INTELLECTUAL PROPERTY RIGHTS, BRAND OWNERSHIP & PROPRIETARY CONTENT PROTECTION
21.1 Ownership of Platform IP
All rights, titles, and interests in the Winngoo Infini India Platform, including trademarks, trade names, proprietary algorithms, digital card designs, UI/UX layouts, logos, brand colours, typographical formats, codebase, databases, animations, transitions, illustrations, sound elements, premium templates, AI-generated variations, watermark systems, and design libraries are exclusively owned by Winngoo Infini India and, where applicable, Winngoo Infini UK or other affiliated entities.
21.2 No Transfer of Rights
The User acknowledges that purchase of a digital card grants only a limited personal usage licence and does not constitute:
- transfer of ownership
- assignment of copyright
- acquisition of commercial rights
- authorisation to reproduce, repackage, or monetise
21.3 Protection of Derivative Works
Any derivative design, edited variation, customised version, or modified output created using platform tools shall be deemed proprietary to Winngoo, including:
- recoloured templates
- text-edited versions
- user-uploaded photo-based variations
- AI-enhanced renderings
21.4 Restrictions Against Reverse Engineering
Users are expressly prohibited from:
- decoding product files
- extracting template layers
- downloading platform assets through non-standard processes
- copying CSS/HTML/UI components
- deploying scraping bots or automated extraction tools
21.5 Protection of Brand Identity
The User may not in any context:
- replicate Winngoo's branding
- imitate design catalogues
- create similar digital greeting card services for competition
- distribute counterfeit or look-alike cards
21.6 Third-Party Content
Content licensed to Winngoo from third-party creators remains under their exclusive copyright. Any misuse on the User's part may lead to legal action by the respective copyright holder.
21.7 Violation Consequences
Any breach of IP provisions enables Winngoo to:
- suspend account access
- issue legal notices
- seek damages under Indian Copyright Act
- report infringement to digital authorities
- initiate civil and criminal proceedings
22. USER RESPONSIBILITIES, CONDUCT, AND ACCEPTABLE USAGE STANDARDS
22.1 General Conduct Obligations
Users must always:
- behave ethically
- comply with law
- refrain from misuse of platform assets
- provide accurate information
- maintain account security
22.2 Prohibited Behaviour
The User shall not:
- impersonate individuals or brands
- upload sensitive or illegal images
- generate offensive or hateful cards
- commit digital identity fraud
- disseminate harmful files
- exploit the platform commercially
22.3 Restrictions on Automated Usage
The User shall not employ:
- bots
- automated rendering systems
- script-based card generators

All uploaded images, photos, names, and personal data must be lawful. Winngoo bears no liability for:
- copyright breach
- misuse of third-party photos
- defamation created by user content
22.5 Responsibility for Card Distribution
Winngoo does not control or regulate how Users distribute digital cards after purchase. Any legal or reputational consequences caused by user distribution remain entirely the User's responsibility.
22.6 Consequences for Breach
Violations may result in:
- account freezing
- content deletion
- withdrawal of licence
- reporting to authorities
23. DATA STORAGE, ACCOUNT SECURITY & USER ACCESS MANAGEMENT
23.1 User Duty to Safeguard Credentials
Users must protect their login details. Any transaction performed through their account shall be deemed authorised.
23.2 Storage of User Files
Winngoo may store temporary user-generated files for:
- (a) rendering processes,
- (b) troubleshooting,
- (c) order verification.
Such files may be auto-deleted after internal retention cycles.
23.3 Multi-Device Login Restrictions
Multiple simultaneous logins may trigger automated security flags or temporary access locks.
23.4 Account Recovery Protocols
Accounts can be recovered only through email or OTP verification. Winngoo does not manually override authentication for privacy reasons.
24. AI-GENERATED CONTENT RESPONSIBILITY & LIMITATION CLAUSE
24.1 Nature of AI Outputs
Where AI tools are used, the User acknowledges that:
- (a) outputs are system-generated,
- (b) variations may not be identical to previews,
- (c) AI may introduce stylistic deviations.
24.2 User Responsibility
Users must ensure AI-generated outputs do not violate:
- morality standards,
- copyright laws,
- personal rights of individuals.
24.3 Prohibition Against Deepfake or Harmful Usage
Users may not use platform tools to:
- (a) create synthetic impersonation media,
- (b) manipulate identities in misleading ways,
- (c) generate abusive or defamatory content.
25. REFUND, CANCELLATION & NON-REVERSIBILITY FRAMEWORK
25.1 Zero-Refund Rule for Digital Goods
Due to the irreversible nature of digital delivery, Winngoo maintains a strict no-refund, no-cancellation, no-return policy.
25.2 Non-Reversible Transactions
Once a digital card is generated, rendered, or accessed, the purchase is final.
25.3 Exceptional Refund Scenarios (Extremely Limited)
Refunds are permitted only where:
- duplicate payment occurred,
- technical error charged user without delivering file.
Even these require mandatory verification logs.
25.4 Refund Denial Scenarios
Refund shall NOT be provided if:
- (a) the user dislikes design,
- (b) the file failed to open due to device issues,
- (c) the user entered incorrect names/photos,
- (d) festival date passed,
- (e) user changed preference after download.
26. PLATFORM MAINTENANCE, SUSPENSION & DISCONTINUATION RIGHTS
26.1 Winngoo may suspend functionalities for upgrades.
26.2 Sudden downtimes may occur without notice.
26.3 Design catalogues may be removed without obligation to preserve older assets.
26.4 Paid user accounts may be suspended for misuse.
27. THIRD-PARTY API INTEGRATION, PAYMENT GATEWAYS & DEPENDENCY RISKS
27.1 Winngoo integrates third-party systems such as Razorpay, PayTM, SMS providers, email service APIs.
27.2 Winngoo is not responsible for:
- failed transactions,
- delayed OTPs,
- third-party outages.
27.3 Platform liability ends once payment is successfully handed to gateway.
28. LEGAL JURISDICTION, GOVERNING LAW & DISPUTE FORUMS
28.1 Jurisdiction: Tamil Nadu, India.
28.2 Courts of Chennai shall have exclusive jurisdiction.
28.3 Users waive rights to initiate proceedings elsewhere.
29. DISPUTE RESOLUTION PROCESS & ARBITRATION FRAMEWORK
29.1 Users must first file a written grievance.
29.2 If unresolved within 30 days, matter goes to arbitration.
29.3 Arbitrator appointed by Winngoo.
29.4 Proceedings in English.
29.5 Arbitration venue: Chennai.
30. LIMITATION OF LIABILITY & MAXIMUM CLAIM CAP
30.1 Maximum liability capped at the transaction amount.
30.2 No liability for:
- emotional loss,
- data loss,
- festival missed deadlines,
- business damages.
31. MARKETING COMMUNICATIONS, PROMOTIONS & CONSENT MANAGEMENT
31.1 Users consent to email/SMS marketing.
31.2 Opt-out available but may affect updates.
31.3 Offers may vary per user.
32. PLATFORM AUDITS, COMPLIANCE CHECKS & INVESTIGATION RIGHTS
32.1 Winngoo may audit usage logs.
32.2 Accounts violating rules may be blocked.
32.3 Investigations may continue even after account closure.
33. PLATFORM TECHNOLOGY INFRASTRUCTURE & SYSTEM ARCHITECTURE DISCLOSURE
33.1 Overview of Technology Stack
Winngoo Infini India operates on a proprietary digital infrastructure combining:
- (a) cloud-hosted servers with scalable deployment;
- (b) distributed storage nodes;
- (c) encrypted data pipelines;
- (d) secured rendering engines for generating digital cards;
- (e) controlled-access administrative dashboards.
33.2 Front-End & User Interface Systems
The platform interface uses responsive front-end frameworks optimised for:
- high-resolution image processing,
- rapid template loading,
- secure in-browser editing components,
- optimised caching for faster rendering.
Users acknowledge that UI performance varies depending on device, browser version, RAM, and OS compatibility.
33.3 Backend Processing & Database Operations
The backend includes:
- (a) automated template delivery systems;
- (b) user session authentication services;
- (c) load balancers;
- (d) redundancy servers for high uptime;
- (e) isolated microservices that process personalisation requests.
Winngoo may reorganise backend architecture without notifying users.
33.4 Rendering Engine Operations
The digital card rendering system may apply:
- image optimisation protocols,
- anti-copy compression layers,
- watermark embedding modules,
- resolution-locking constraints to prevent tampering.
33.5 Data Protection Measures
To maintain platform integrity, Winngoo employs:
- (a) SSL/TLS encryption;
- (b) firewall filtering;
- (c) periodic database sanitisation;
- (d) strict access control policies;
- (e) automated anomaly detection for suspicious requests.
33.6 Third-Party Infrastructure Dependency
The platform may rely on:
- cloud providers (AWS, GCP, Azure or equivalent),
- CDN distributors,
- email/SMS gateways,
- caching servers.
Service delays or outages caused by such providers are not attributable to Winngoo.
33.7 System Upgrades & Feature Reconfiguration
Winngoo may introduce upgrades including redesigns, version transitions, feature additions, and feature retirements. Users acknowledge that:
- (a) older templates may be archived,
- (b) stored files may not be accessible after retirement,
- (c) platform performance may temporarily fluctuate during maintenance cycles.
33.8 Technology Ownership
All system architecture, APIs, software logic, automation scripts, rendering algorithms, and platform flows remain exclusive proprietary property of Winngoo Infini (India and UK). Reverse engineering, cloning, or duplicating system architecture is strictly prohibited.
34. COMPLIANCE WITH INFORMATION TECHNOLOGY ACT, 2000, CERT-IN GUIDELINES & INDIAN DIGITAL LAWS
34.1 Applicability of Indian IT Laws
The User acknowledges that all platform activities are governed by:
- (a) Information Technology Act, 2000;
- (b) Information Technology (Intermediary Guidelines & Digital Media Ethics Code) 2021;
- (c) CERT-In Cybersecurity Directions, 2022;
- (d) Indian Contract Act, 1872;
- (e) Consumer Protection (E-Commerce) Rules, 2020;
- (f) Applicable IP laws.
34.2 Intermediary Role & Safe Harbour Protection
Winngoo Infini acts as a digital intermediary where applicable and is protected under Section 79 of the IT Act, provided it:
- (a) does not initiate transmission;
- (b) does not modify user content;
- (c) removes unlawful content upon valid notice.
Users must not upload content that violates IT Act Section 67, 67A, 67B or any regulations related to obscenity, privacy violation, or defamation.
34.3 User Accountability for Illegal Content
Users alone are responsible for any illegal images, personal data of third parties, copyrighted photos, or abusive messages uploaded into digital cards. Winngoo reserves the right to:
- report unlawful content to authorities,
- preserve evidence logs,
- suspend accounts immediately.
34.4 Compliance with CERT-In Cybersecurity Rules
Winngoo may store and maintain:
- (a) server logs,
- (b) timestamps,
- (c) IP information,
- (d) user device metadata,
for mandatory durations required under CERT-In regulations for security and audit purposes.
34.5 Data and Content Removal on Legal Notices
If Winngoo receives a valid:
- court order,
- government direction,
- legal notice,
it may remove or restrict access to specific user-generated content.
34.6 Prohibition Against Misuse Under IT Act
Users may not engage in activities that fall under:
- (a) unlawful access (Sec. 43),
- (b) data theft (Sec. 66),
- (c) identity impersonation (Sec. 66C),
- (d) cyber fraud (Sec. 66D),
- (e) transmission of obscene material (Sec. 67).
Violations may result in legal prosecution.
34.7 Digital Evidence & Cooperation with Authorities
Winngoo may assist law enforcement by providing:
- (a) digital logs,
- (b) content snapshots,
- (c) account activity metadata,
- (d) internal audit trails,
subject to due legal process.
34.8 Legal Responsibility of Users
Any harm, fraud, or misuse committed using Winngoo-generated digital cards shall be the sole legal liability of the User. Winngoo is not responsible for disputes between users and third parties arising from personalised card content.
